Who exactly is considered disabled in a company?
It’s not just people with visible disabilities. This status is granted to employees who have submitted one of the following documents:
A disability degree certificate (issued by the District or Voivodeship Assessment Team).
A work incapacity certificate (issued by a ZUS medical examiner).
A disability group certificate (issued before 1997 – if still valid).
Validity of the certificate
Disability status is not granted “forever.” As an employer, you must monitor the dates:
Permanent certificates: Permanent, do not require renewal.
Temporary certificates: Valid until a specific date. To maintain continued PFRON benefits, the employee must apply for a new certificate before the previous one expires. If a new certificate is submitted on time, the discounts will be applied retroactively!
Preventive Care and Additional Entitlements
Working Hours: A person with a significant or moderate degree of disability works a maximum of 7 hours per day (35 hours per week) while maintaining full remuneration.
Additional Leave: An employee is entitled to an additional 10 working days of annual leave per calendar year (after one year of service since obtaining the certificate).
Work Break: An additional 15 minutes for exercise or rest.
